That's what happened to the real Kondo. They blamed him for the death of Sakamoto Ryoma and executed him for it - it was actually a lot more complex than that (as it was a mostly political move), but that was the main charge.
He surrendered in a fight and was beheaded on May 17, 1868 - his executioners were the new government, consisting of the former samurai from the Choshu and Satsuma domains. They falsely accused him of Ryoma's death, even though the person responsible was actually Imai Nobuo of the Mimawarigumi. ...The Mimawarigumi were a similar special force as the Shinsengumi, though Mimawarigumi had higher status and protected Kyoto's imperial palace (Shinsengumi looked after the common people).
PS. Nearly every single Shinsengumi member died young, either before or after Kondo. The only two to survive into old age were Nagakura Shinpachi and Saito Hajime. Kondo himself was 34; Hijikata also died at 34 (a bullet broke his spine); Inoue Genzaburo died at 39 during the Boshin War; Okita died from tuberculosis at 24-26; Harada died at 28 (he left a wife and child behind); Sannan-san died at 32 (he was the first of them to go - three years before Kondo, he committed seppuku); Toudou died at 23 (a year before Kondo - his own Shinsengumi ally killed him).
